1. Introduction and Agreement
Welcome to AllMYAI. These Terms of Use ("Terms") govern your access to and use of the AllMYAI platform, website (allmyai.ai), applications, APIs, and related services (collectively, the "Services").
These Terms constitute a legally binding agreement between you and Concept Dzign LLC, a Delaware limited liability company ("AllMYAI," "we," "us," or "our") located at:

By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
Your use of the Services is also governed by our Privacy Policy and Cookie Policy, both of which are incorporated into these Terms by reference.
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Concept Dzign LLC regarding the Services and supersede all prior agreements or representations.

2. Eligibility and Accounts
Minimum Age
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. Users under 18 must have permission from a parent or legal guardian.
We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate the account and delete all associated data promptly and in accordance with applicable law, including the Children's Online Privacy Protection Act (COPPA).
Account Registration
To access certain features you may need to create an account. You agree to:
Provide accurate and complete registration information
Keep your login credentials secure and confidential
Not share your account credentials with third parties
Notify us immediately of any unauthorized account access at support@allmyai.ai
You are responsible for all activity that occurs under your account.
Organizational Accounts
If you register using an organization email address (such as an employer or school), that organization may control your account and access your content according to its own internal policies. We are not responsible for the organization's access to or handling of your content. We recommend reviewing your organization's data and privacy policies before registering with a work or institutional email address.

3. Use of the Services
You may use the Services only for lawful purposes and in compliance with these Terms.
You agree not to:
Violate any applicable law or regulation
Infringe intellectual property, privacy, or publicity rights of any person or entity
Reverse engineer, decompile, or attempt to extract proprietary models or technology
Attempt to discover source code protected under U.S. Patent Pending #64/002,941
Scrape, crawl, or extract data using automated tools without prior written permission
Misrepresent AI-generated output as purely human-generated content
Create, distribute, or facilitate harmful, deceptive, or illegal content
Generate deepfakes or non-consensual synthetic media designed to deceive or harm
Create, distribute, or solicit child sexual abuse material (CSAM) in any form
Develop, distribute, or deploy malware, cyberweapons, or malicious code
Interfere with elections, democratic processes, or create content designed to suppress voting
Harass, threaten, defame, or impersonate any individual or entity
Violate US export control laws including the Export Administration Regulations (EAR) and sanctions enforced by the Office of Foreign Assets Control (OFAC)
We reserve the right to suspend or terminate access for any violation and to report illegal activity to law enforcement authorities where required or appropriate.

4. API Usage
If you access the Services through our application programming interface (API):
You may not use the API to replicate or build competing Services without prior written consent
You are solely responsible for securing your API keys and preventing unauthorized use
We may impose rate limits, usage quotas, or technical restrictions at our discretion
API availability is not guaranteed unless covered by a separate written Service Level Agreement (SLA)
Applications you build using the API must comply with these Terms and must not misrepresent their use of AllMYAI technology

5. Third-Party Services
The Services may integrate or connect with third-party providers, including:
AI model providers
Cloud infrastructure and hosting services
Payment processors
These third-party services operate under their own terms, policies, and privacy practices. We are not responsible for their operations, availability, security, or data handling. We recommend reviewing the terms and privacy policies of any third-party services you interact with through the Services.

6. User Content (Input and Output)
Input
You may submit prompts, files, or other materials to the Services ("Input").
You retain full ownership of your Input. You represent and warrant that you have all rights necessary to submit your Input and that it does not violate any law or third-party rights.
Output
The Services may generate responses based on your Input ("Output").
To the extent permitted by law, AllMYAI assigns any rights it may have in the Output to you. However, you acknowledge that:
Output may not be unique — similar or identical outputs may be generated for other users from similar inputs
Output does not represent the views, opinions, or positions of AllMYAI or Concept Dzign LLC
You are solely responsible for how you use, publish, or distribute Output
Output should be reviewed and verified before use in any consequential context
License to Operate the Services
You grant us a limited, worldwide, non-exclusive, royalty-free license to process, transmit, and use your Input solely to provide, maintain, and improve the Services, as further described in our Privacy Policy.

7. Data Use and AI Training
We value user privacy and are committed to transparency about how your data is used.
Paid Tier Users
Your content is not used to train our AI models unless you explicitly opt in through your account settings.
Free Tier Users
By using the free tier, you acknowledge that your inputs may be used to help improve our AI models. This will be clearly disclosed at the time of free tier registration.
All users may opt out of AI training at any time by:
Adjusting your preferences in account settings, or
Contacting us at support@allmyai.ai
For users in the European Economic Area (EEA), United Kingdom, or Switzerland, any use of your data for AI training will be subject to a valid legal basis under applicable data protection law, including your explicit consent where required by the General Data Protection Regulation (GDPR).

8. Data Retention and Account Deletion
We retain personal data only as long as necessary to provide the Services or comply with legal obligations.
Upon account deletion:
Personal data will be deleted or anonymized within 30 days of your verified deletion request
Backup copies may persist in secure storage for up to 90 days before permanent deletion
Anonymized or aggregated data that cannot be linked to you may be retained indefinitely for analytics and service improvement

9. Accuracy and AI Limitations
AI systems are probabilistic and may produce results that are inaccurate, incomplete, or misleading.
Outputs:
May contain errors, omissions, or hallucinations
May reflect biases present in training data
May become outdated over time
Should be independently verified before being relied upon
We make no guarantees regarding the accuracy, completeness, or reliability of any Output, and Output does not represent the views of AllMYAI.

10. No Professional Advice
Output is for general informational purposes only. It does not constitute and should not be relied upon as:
Legal advice — consult a licensed attorney
Medical or clinical advice — consult a licensed healthcare provider
Financial or investment advice — consult a licensed financial advisor
Mental health advice — consult a licensed mental health professional
Always consult a qualified professional before making decisions based on content generated by the Services. Use at your own risk.

11. Prohibited High-Risk Uses
The Services may not be used — without appropriate human oversight and accountability measures — to make automated or semi-automated decisions with significant impact on individuals, including:
Employment decisions (hiring, promotion, termination)
Credit or lending eligibility
Housing or tenancy
Insurance underwriting or claims
Legal determinations or criminal proceedings
Educational admissions
Such uses may violate applicable law, including emerging AI-specific regulations such as the EU AI Act.

12. Intellectual Property
All technology, software, AI models, trademarks, logos, and branding associated with AllMYAI are owned by Concept Dzign LLC or its licensors and are protected by applicable intellectual property laws.
Technology protected under U.S. Patent Pending #64/002,941 may not be copied, modified, reverse-engineered, or distributed without prior written permission from Concept Dzign LLC.
Nothing in these Terms grants you any rights to our intellectual property beyond what is expressly stated herein.

13. DMCA and Copyright Policy
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Reporting Infringement
If you believe content on the Services infringes your copyright, submit a written notice to our designated DMCA Agent:

Your notice must include:
Physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to be infringed
Identification of the allegedly infringing material and its location on the Services
Your contact information (name, address, phone number, email)
A statement of good faith belief that the use is not authorized by the rights holder
A statement under penalty of perjury that the notice is accurate and you are authorized to act
Counter-Notice
If you believe content was removed in error, you may submit a counter-notice to the same contact. Your counter-notice must include your contact information, identification of the removed content, a statement under penalty of perjury that removal was a mistake, and your consent to jurisdiction in Delaware. We will process counter-notices in accordance with the DMCA.

14. International Users and Privacy Rights
European Users (GDPR)
If you are located in the EEA, United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation (GDPR) or equivalent applicable law:
Access — request a copy of personal data we hold about you
Rectification — request correction of inaccurate data
Erasure — request deletion of your personal data
Restriction — request limits on how we process your data
Data Portability — receive your data in a structured, machine-readable format
Objection — object to processing based on legitimate interests
Withdrawal of Consent — withdraw consent at any time where processing is consent-based
To exercise these rights, contact support@allmyai.ai. We will respond within 30 days. Business customers in the EEA may request a Data Processing Agreement (DPA) by contacting support@allmyai.ai, as required under GDPR Article 28.
United States Residents
If you are a resident of any US state with an enacted consumer privacy law, including California, Virginia, Colorado, Connecticut, Utah, Iowa, Indiana, Tennessee, Montana, Oregon, Texas, Delaware, New Hampshire, New Jersey, Kentucky, Maryland, Minnesota, Nebraska, Rhode Island, Florida, and others, you have the following rights under your applicable state statute.
You have the right to know what categories of personal information we collect about you and how it is used and shared. You have the right to access the specific personal information we hold about you. You have the right to request deletion of personal information we have collected, subject to certain legal exceptions. You have the right to request correction of inaccurate personal information. You have the right to opt out of the sale of your personal information, the sharing of your personal information for cross-context behavioral advertising, and the use of your personal information for targeted advertising. You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. You have the right not to receive discriminatory or retaliatory treatment for exercising any of your privacy rights.
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising without your consent.
Where your state law requires it, we will also honor the right to limit the use of sensitive personal information to purposes expressly authorized under applicable law.
To submit a US privacy request, please email us at support@allmyai.ai with the subject line "US Privacy Request" and include your state of residence. We will process your request in accordance with the law applicable to your state.
Other Jurisdictions
We are committed to respecting applicable data protection laws regardless of where you are located. Nothing in these Terms limits any mandatory consumer protection or privacy rights available under the laws of your local jurisdiction.

15. Payment and Subscriptions
Paid Services require valid payment information. By subscribing, you agree to:
Provide accurate and current payment details
Pay all applicable fees as they become due
Accept automatic subscription renewal unless you cancel before the renewal date
Price Changes
We may update pricing with at least 30 days' advance notice, delivered via email to the address associated with your account or through a prominent notice within the Services. Continued use of the Services after a price change takes effect constitutes acceptance of the new pricing.

16. Refund Policy
Payments are generally non-refundable.
Pro-rated refunds may be issued at our discretion in cases such as:
Verified technical outages caused by our systems lasting more than 48 consecutive hours
Accidental subscription renewals reported to us within 24 hours of the renewal charge
Refund requests must be submitted to support@allmyai.ai with your account details and a description of the issue. We reserve the right to request supporting documentation.

17. Suspension and Termination
We may suspend or terminate your access to the Services if:
You violate these Terms
Required to do so by applicable law or court order
We discontinue the Services (with reasonable advance notice where practicable)
Fraud, abuse, or harmful activity is detected in connection with your account
Upon termination, your right to use the Services ends immediately. Data handling following termination is governed by Section 8 of these Terms.
Survival
The following sections survive any termination or expiration of these Terms: Intellectual Property (§12), DMCA and Copyright Policy (§13), Disclaimer of Warranties (§18), Limitation of Liability (§19), Indemnification (§20), Dispute Resolution (§23), Governing Law (§24), and any other provisions that by their nature should survive.

18. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, completeness, or reliability of results
Uninterrupted, error-free, or virus-free operation
That the Services will meet your specific requirements

19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONCEPT DZIGN LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any and all claims related to the Services will not exceed the greater of:
The total amount paid by you to AllMYAI in the 12 months immediately preceding the claim, or
One hundred US dollars ($100.00)
Some jurisdictions do not permit certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

20. Indemnification
You agree to indemnify, defend, and hold harmless Concept Dzign LLC and its employees, officers, directors, contractors, licensors, and partners from any third-party claims, damages, losses, liabilities, and expenses — including reasonable attorneys' fees — arising from:
Your use of the Services
Your violation of these Terms
Your violation of any applicable law or regulation
Your infringement of any third-party intellectual property, privacy, or publicity rights
Any content you submit through the Services
We reserve the right to assume exclusive control of any matter subject to indemnification at our own expense, in which case you agree to cooperate with our defense.

21. Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government actions, cyberattacks by third parties, telecommunications failures, or acts or omissions of third-party service providers.
We will use commercially reasonable efforts to resume normal performance as soon as practicable following any such event and will notify affected users where feasible.

22. Assignment
We may assign, transfer, or delegate any of our rights or obligations under these Terms — including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets — by providing notice to you via email or through the Services.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.

23. Dispute Resolution
Informal Resolution
Before initiating any formal legal proceeding, you agree to contact us at support@allmyai.ai to attempt informal resolution. We will make good faith efforts to resolve the dispute within 60 days of receiving your written notice.
Binding Arbitration
If the dispute is not resolved informally within 60 days, it will be finally resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org), rather than in court.
Arbitration will take place in the State of Delaware, or via remote hearing (telephone or videoconference) at your election if you are located outside Delaware. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CONCEPT DZIGN LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST CONCEPT DZIGN LLC.
If this class action waiver is found to be unenforceable for a particular claim, that claim alone will be excluded from arbitration and brought in a court of competent jurisdiction in Delaware. All other claims remain subject to arbitration.
Exceptions
Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

24. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Notwithstanding the above, nothing in these Terms limits any mandatory consumer protection, data privacy, or other rights available to you under the laws of your jurisdiction of residence that cannot be contractually waived.

Announcements posted on our website
Email notices are deemed effective 24 hours after transmission. You are responsible for keeping your registered email address current. To update your contact information, visit your account settings or contact support@allmyai.ai.

26. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Concept Dzign LLC regarding the Services and supersede all prior or contemporaneous agreements, communications, and proposals.
Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms at any time does not waive our right to enforce that provision or any other provision in the future.
Relationship of the Parties. These Terms do not create any partnership, joint venture, employment, franchise, or agency relationship between you and Concept Dzign LLC.
Headings. Section headings are for convenience and navigation only and have no legal effect.

27. Changes to These Terms
We may update these Terms periodically to reflect changes in our Services, applicable law, or business practices.
For material changes, we will:
Update the "Last Updated" date at the top of this document, and
Notify you by email to the address associated with your account or by displaying a prominent notice within the Services
Material changes take effect 14 days after notice is provided, except where immediate changes are required by law. Continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services before the effective date.
